The State of Florida has two types of Licensed County Private Process Servers:

1. Special Process Server, SPS Process Server, a Sheriff Appointed and licensed Process Server
2. Certified Process Server, CPS, a Court Certified Process Server

Florida Statutes, see www.Chapter48Florida.com, require service of a Summons and all non-enforceable civil process be served by the Sheriff of the county where service is to be made OR a private Licensed Process Server. A private process server must be a S. P .S. or C.P.S. in order to lawfully serve a Summons in Florida. In some counties the court requires and Motion and Order before service can be attempted or made. Florida Law requires serving legal process in accordance with chapter 48. However, if legal process originates from outside the state of Florida service of process is served in accordance with the statutes of the issuing jurisdiction.

There are two different ways you serve the Insurance Commissioner. The first
is if they are being served on behalf of an insurance company doing business
in the state of Florida. It is imperative that the insurance company be listed
exactly as it is recorded with the Florida Secretary of State (850) 488-9000, or
the service will be invalid and must be re-served. When serving them this way
the following documents are required

Three (3) Summons
Two (2) Complaints and all related attachments
A Check in the amount of $15.00 made out to the "Florida Insurance
Commissioner."

If serving a subpoena or any other legal papers [please remember you must send a total of
three service packets. Anything service less than three copies will be declined a

The second way to serve the Insurance Commissioner is if they are being
served on behalf of another municipal or governmental agency which is being
sued. This is pursuant to F.S. 768.28 (7). When serving the Insurance
Commissioner in this capacity you do not need the extra copies or the $15.00
fee. It is just like serving any other document; however, you should list on the
summons that you are serving the Insurance Commissioner pursuant to F.S.
768.28(7).
